Terms of Service

1. Agreement

By using CreInk ("the Service"), you agree to these Terms of Service. If you do not agree, do not use the Service. We may update these terms at any time; continued use after changes constitutes acceptance.

2. Eligibility

You must be at least 13 years old to use CreInk. If you are under 18, you must have parental or guardian consent. By placing an order, you represent that you meet these requirements.

3. Acceptable Use

You may not use CreInk to:

  • Generate designs that infringe copyrights, trademarks, or other intellectual property rights
  • Create content containing hate speech, explicit/pornographic imagery, or depictions of violence
  • Violate any applicable local, state, national, or international law
  • Attempt to circumvent usage limits, rate limits, or security measures
  • Resell generated designs as standalone digital products (printed merchandise is fine)

We reserve the right to refuse or cancel any order that violates these terms.

4. Intellectual Property

You retain rights to the prompts you submit. AI-generated images are produced under the terms of our AI provider (Ideogram). CreInk does not claim ownership of your generated designs. You are solely responsible for ensuring your prompts and resulting designs do not infringe on third-party rights.

5. Orders, Pricing & Fulfillment

All prices are listed in USD and include applicable taxes where required. We reserve the right to change prices at any time. Orders are typically fulfilled within 5-7 business days (2-3 for rush orders).

We strive for accuracy in product images and descriptions but cannot guarantee that colors on screen will match printed output exactly due to differences between digital displays and print processes.

6. Refunds & Returns

Because each item is custom-made to order, all sales are generally final. We will reprint or refund orders in the following cases:

  • The printed item has a manufacturing defect (misaligned print, wrong size, damaged in production)
  • The wrong item was shipped
  • The item was damaged during shipping

To request a refund or reprint, contact us within 14 days of delivery with photos of the issue. We do not accept returns for buyer's remorse or because the design didn't meet subjective expectations.

7. Generation Tokens

Free generation tokens are provided for trial use and are non-transferable. Purchased tokens do not expire but are non-refundable. We reserve the right to modify free token allowances at any time.

8. Payments

Payments are processed securely by Stripe. CreInk does not store your credit card details. By placing an order, you authorize Stripe to charge the applicable amount.

9. Limitation of Liability

To the maximum extent permitted by law, CreInk and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, including but not limited to loss of profits, data, or business opportunities. Our total liability for any claim shall not exceed the amount you paid for the specific order giving rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless CreInk, its operators, and service providers from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from your use of the Service, your violation of these terms, or your infringement of any third-party rights.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that AI-generated images will be suitable for any particular purpose, that the Service will be uninterrupted, or that results will meet your expectations.

12. Governing Law

These terms are governed by the laws of the State of California, United States, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of Los Angeles County, California.

13. Termination

We may suspend or terminate your access to the Service at any time, without notice, for conduct that we determine violates these terms or is harmful to the Service or other users.
